Applicant is requesting an additional sign MOTION: IN CASE NUMBER 04-116 MOVE TO APPROVE THE VARIANCE FOR THE WEST WALL, CENTER SIGN (FRONT OF BUILDING) "STAPLES –THE OFFICE SUPERSTORE." THE APPROVED SIGN IS TO BE 115 SQUARE FEET AS SHOWN ON THE REVISED PLANS SUBMITTED AT THE MEETING. APPROVE THE EAST WALL (REAR OF BUILDING) "STAPLES" SIGN FOR IDENTIFICATION PURPOSES AS REQUESTED AT 125 SQUARE FEET. MOVE TO DENY THE TWO ADDITIONAL SIGNS ("COPY AND PRINT CENTER" AND "OFFICE SUPPLIES") ON THE FRONT OF BUILDING BECAUSE THE PETITIONER HAS NOT ESTABLISHED THAT IT WOULD NOT IMPAIR ADEQUATE LIGHT AND SUPPLY DUE TO OVERSHADOWING OTHER BUSINESSES.
4. Case No. ZBA 04-117 filed by Gregory Gluck of Fox Run Village at 41000 W. 13 Mile Road Gregory M. Gluck of Fox Run Village is requesting one (1) sign variance to maintain a temporary construction sign for Fox Run Village at 41000 W. 13 Mile Road. Fox Run Village is located on the north side of 13 Mile Road, east of Meadowbrook and west of M-5 Expressway. CITY OF NOVI, CODE OF ORDINANCES, Section 28-7 (1) states: "Construction identification sign…is valid for a period of twelve months..." The Applicant is requesting permission to allow the sign to remain for an appropriate amount of time as determined by the Board. MOTION: IN CASE NUMBER 04-117 MOVE TO GRANT THE SIGN VARIANCE FOR THREE (3) YEARS WITH CONTINUING JURISDICTION. THE APPROVAL IS DUE TO THE FACT THAT FOX RUN VILLAGE IS A MAMMOTH, LONG-TERM PROJECT. THE VARIANCE APPROVAL WILL END ON MARCH 1, 2008.
5. Case No. ZBA 04-118 filed by K.J. Albers of Diversified Land Development, LLC for the Charneth Fen Condominiums Development at Twelve ½ Mile Road Mr. Albers of Diversified Land Development, LLC is requesting one (1) sign variance to erect a ground sign to be located at the southwest corner of Twelve ½ Mile Road and Novi Road advertising Charneth Fen Condominiums Development. Charneth Fen Condominiums Development is located on the south side of Twelve ½ Mile Road, one eighth of a mile west of Novi Road. The property is zoned RM-1 and is north of Twelve Mile and west of Novi Road. CITY OF NOVI, CODE OF ORDINANCES, Section 28-9 (1) states: Off-premises signs – "Ground pole signs and wall signs only shall be permitted in an I-2 district." Applicant is requesting to erect an off-premise sign. MOTION: IN RESPECT TO CASE NO. 04-118 MOVE THAT THE PETITIONER’S REQUEST FOR THIS OFF-SITE SIGN BE GRANTED FOR THE PURPOSE OF MARKETING AND FOR A PERIOD OF ONE YEAR.
6. Case No. ZBA 04-119 Glenn Klocke for residence at 44480 Eleven Mile Road Mr. Klocke is requesting three (3) variances for the construction of an addition to his residence located at 44480 Eleven Mile Road. Applicant is requesting a 2.25 foot west side yard setback variance which includes a variance request for the aggregate total of both side yards of 2.25 feet and a one (1) foot front setback variance. Property is zoned R-4 and located in Section 15, Lot #5 of Mary’s Orchard Subdivision. Property is north of Eleven Mile between Novi Road and Taft Road. NOVI CODE OF ORDINANCES: ARTICLE 24; Section 2400, "Schedule of Regulations" require a minimum front yard setback of thirty (30) feet and an aggregate total of both side yards of twenty-five (25) feet in an R-4 zoning District. 7. Case No. ZBA 04-121 filed my David Bastianelli for North Haven Woods Mr. Bastianelli is requesting a Temporary Use Permit for six (6) months for the continued placement of a construction trailer on Lot #18, 44610 Ludlow in the North Haven Woods Subdivision located south of Pontiac Trail and east of West Park Drive. Applicant had initially received a Temporary Use Permit, TUP 02-051 that has expired. NOVI CODE OF ORDINANCES: Section 3004, Paragraph 2a Temporary Use Permits states: Permit in any residential district the temporary location of a temporary or premanufactured building in new subdivisions irrespective of the requirements of Section 302 of the Ordinance, provided the use shall be limited to construction offices and offices for the specific purpose of selling lots or new homes to be erected in a subdivision. Applicant is requesting an additional six (6) month Temporary Use Approval for the continued placement of the construction trailer at the existing location. MOTION: IN CASE NUMBER 04-115 MOVE TO APPROVE A SIX-MONTH EXTENSION FOR THE CONSTRUCTION TRAILER (THE PERMIT WILL EXPIRE ON JUNE 7, 2005). THE APPROVAL INCLUDES THE FOLLOWING FIVE (5) ITEMS TO BE ADHERED TO AS LISTED IN TUP02-051: THE PERMIT WILL BE UNDER CONTINUING JURISDICTION. NO EXTERIOR LIGHTS TO SHINE ON THE NEIGHBORS. THE SITE MUST BE KEPT IN A NEAT AND ORDERLY MANNER. THE TRAILER MUST BE SKIRTED. THE TRAILER MUST BE ANCHORED TO RESIST WIND UPLIFT AND OVERTURNING.
8. Case No. ZBA 04-122 filed by James and Kim Ziegler for new construction on property located on Dinser Drive Mr. & Mrs. Ziegler are requesting two (2) variances for the construction of a new home located on Parcel C, Sidwell #50-22-20-301-023. Applicant is requesting a south side yard setback variance of six (6) feet and an aggregate total side yard setback variance of six (6) feet for both sides. Property is zoned R-A and located on the west side of Dinser Drive east of Wixom Road and north of Ten Mile Road. NOVI CODE OF ORDINANCES: ARTICLE 24; Section 2400, "Schedule of Regulations" requires a minimum side yard setback of twenty (20) feet with a combined side yard setback of fifty (50) feet. REQUIRED SIDE YARD SETBACK (SOUTH) 25 FEET PROPOSED SIDE YARD SETBACK (SOUTH) 19 FEET VARIANCE REQUESTED 6 FEET REQUIRED AGGREGATE TOTAL OF BOTH SIDES 50 FEET PROPOSED AGGREGATE TOTAL OF BOTH SIDES 44 FEET VARIANCE REQUESTED 6 FEET MOTION: IN CASE NUMBER 04-122 MOVE TO DENY THE VARIANCES REQUESTED DUE TO THE LACK OF HARDSHIP SHOWN BASED ON THE PLANS SUBMITTED.
9. Case No. ZBA 04-123 filed by Matthew S. Sosin of Haggerty Corridor Partners LLC for Columbus Corporate Office Centre Mr. Sosin of Haggerty Corridor Partners LLC. is requesting one sign variance to erect a construction identification sign prior to the issuance of the building permit for Columbus Corporate Office Centre located at the northwest corner of Twelve Mile and Haggerty Roads. The property is zoned OST. CITY OF NOVI, CODE OF ORDINANCES, Section 28-7(1) for Temporary Signs states: "Not to be issued prior to building permit and is valid until issuance of last certificate of occupancy or for a period of twelve (12) months, whichever occurs first." The applicant is requesting one (1) sign variance to erect an 8 foot by 4 foot "V" construction identification sign totaling 64 square foot prior to issuance of the building permit. MOTION: IN CASE NUMBER 04-123 MOVE TO APPROVE THE SIGN VARIANCE WITH THE CONDITION THAT IF A BUILDING PERMIT IS NOT ISSUED, THE SIGN IS TO BE REMOVED. EACH SIDE OF THE "V" SIGN SHALL BE A HEIGHT OF EIGHT (8) FEET WITH THE AREA MEASURING FOUR (4) FEET VERTICAL BY EIGHT (8) FEET HORIZONTAL FOR A TOTAL OF 32 SQUARE FEET. THE SIGN IS APPROVED FOR A PERIOD ON ONE YEAR.
10. Case No. ZBA 04-124 filed by Michael DeBlauw of McShane Construction Corp for Meadowbrook Medical Building at the southeast corner of Meadowbrook and Eleven Mile Roads Mr. DeBlauw of McShane Construction Corp. is requesting two (2) variances for the construction of a new 120,000 square foot, two story office building located in Section 24 at the southeast corner of Meadowbrook Road and Eleven Mile Road. Applicant is requesting the parking lot to occupy more than 50% of the area front yard between the front yard setback and the building façade. Also, that the parking area not be screened by ornamental brick on brick or landscaped berm. Property is zoned I-1 Light Industrial and located on 12.59 acres NOVI CODE OF ORDINANCES: ARTICLE 24; Section 2400, "Schedule of Regulations" Paragraph (h) states that the parking area shall not occupy more than 50% of the area between the minimum front yard setback and building façade setback line. Applicant is requesting the parking area to occupy more than 50% of the area between the minimum front yard setback and building façade setback line. NOVI CODE OF ORDINANCES: Section 2514 and 2509-8 requires the parking lot to be screened by an ornamental brick on brick wall or landscaped berm. Applicant is requesting not to screen the parking area along Meadowbrook Road and Eleven Mile. MOTION: IN CASE NUMBER 04-124 THE PETITIONER’S REQUEST BE GRANTED BECAUSE OF THE PECULIAR LOCATION AND THE CONFIGURATION OF THIS LOT. THE PETITIONER WAS GRANTED 180 DAYS TO OBTAIN THE BUILDING PERMIT BEFORE THE VARIANCE IS VOID.
11. Case No. ZBA 04-125 filed by Amy Davenport of ASI-Modulex for DMC at 41935 Twelve Mile Road Ms. Davenport of ASI - Modulex is requesting two (2) sign variances to erect two additional signs at DMC. DMC is at 41935 Twelve Mile Road, east of Novi Road and west of Meadowbrook Road. The property is zoned OST. Sign one – Small Entrance ID (Location 7 on plot plan) at 41935 Twelve Mile Road CITY OF NOVI, CODE OF ORDINANCES, Section 28-6(3) states: "…no building or parcel of land shall be allowed more than one (1) sign permitted under this section…" Sign two – Building ID w/LED Display (Location 9 on plot plan) CITY OF NOVI, CODE OF ORDINANCES, Section 28-6(3) states: "…no building or parcel of land shall be allowed more than one (1) sign permitted under this section…" The applicant is requesting permission to erect two additional signs. 12. Case No. ZBA 04-126 filed by Marcos Makohon for K-4 Architecture LLC for Citizens Bank on Twelve Mile Road Mr. Makohon of K-4 Architecutre LLC is requesting a variance to the requirements of providing off-street loading and unloading due to the nature of the business of the proposed Citizens Bank project, located on Twelve Mile Road between Cabot Drive and M-5 entrance ramp, Sidwell #5022-12-400-023. Property is zoned OST and is approximately two (2) acres. NOVI CODE OF ORDINANCES: Section 2507 "Off-street Loading and Unloading" requires a loading and unloading space within the OST District. Applicant is requesting a variance to the loading and unloading space requirement due to the nature of the business. Case No. 04-009 presented at the April 6, 2004 ZBA Meeting Mr. Blair Bowman is requesting a six-month extension for the installation of the sign for the new Exposition, Convention and Conference Center. BOARD APPROVED A SIX (6) MONTH EXTENSION THAT WILL EXPIRE JUNE 7, 2005. 2. Case No. 04-001 for Harold Frame Shop approved sign and the hours of illumination. THE BUILDING DEPARTMENT WILL INVESTIGATE THE MATTER 3. Mock-up sign clarification on the time limit for the sign to remain after the case has been approved. THE BUILDING DEPARTMENT WILL REPORT ON THE FINDINGS AT THE JANUARY 4, 2005 ZBA MEETING. 4. Case No.l 04-057 for Glenda’s Market – Board requested information on the status of the fence.
